1. Acceptance of Terms

By downloading, installing, or using HerFlow ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

HerFlow is a period and cycle tracking application designed to help users track menstrual cycles, symptoms, moods, and related health information. The App also allows partners and loved ones to track and support cycle health.

3. Medical Disclaimer

HerFlow is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The information provided by the App is for general informational purposes only and should not be considered medical advice. Always consult with a qualified healthcare provider for medical concerns, family planning decisions, or health-related questions.

Cycle predictions and fertility estimates are based on general patterns and may not be accurate for your individual cycle. Do not rely on HerFlow for contraception or conception planning without consulting a healthcare professional.

4. User Responsibilities

You agree to:

• Use the App only for its intended purpose
• Provide accurate information when using the App
• Keep your device and the App secure
• Not use the App for any unlawful purpose
• Not attempt to reverse engineer, modify, or distribute the App

5. Subscriptions and Payments

HerFlow offers optional subscription plans ("HerFlow People") that provide access to premium features:

• Monthly subscription: Billed monthly
• Yearly subscription: Billed annually

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

Payment is charged to your Apple ID account at confirmation of purchase. All payments are processed by Apple and are subject to the App Store's terms and conditions.

Free trial periods, if offered, will automatically convert to a paid subscription unless canceled before the trial ends.

6. Intellectual Property

The App, including its content, features, and functionality, is owned by HerFlow and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using the App, you consent to the practices described in the Privacy Policy.

8. Data and Backups

Your data is stored locally on your device by default. We are not responsible for any loss of data due to device malfunction, app deletion, or other circumstances. We recommend regularly backing up your device.

9. Partner Sync Feature

The Partner Sync feature allows you to share cycle information with others using a unique code. This feature is designed with privacy and anonymity in mind:

• Fully anonymous: All synced data is linked only to a random code, not to any personal information
• No identifiers: We never collect names, emails, or any data that could identify you
• You control access: Only people you personally share your code with can view your data
• No surveillance possible: Without your unique code, data cannot be traced to any individual

You are responsible for sharing your code only with trusted individuals. We are not responsible for any consequences of sharing your information with others.

10. Limitation of Liability

To the maximum extent permitted by law, HerFlow and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or information
• Personal injury or health consequences
• Decisions made based on App predictions
• Any other damages arising from the use of the App

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

12. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

13. Termination

We reserve the right to terminate or suspend access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
